1. Acceptance of Terms

By accessing or using Hirearchy ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform. We may update these terms from time to time, and continued use of the Platform constitutes acceptance of any changes.

2. About the Platform

Hirearchy is a marketplace that connects job providers with independent professionals, primarily carers and cleaners, in Northern Ireland. The Platform facilitates introductions between providers and agents but is not a party to any employment or service agreement between users. Hirearchy does not employ, endorse, or guarantee the work of any agent listed on the Platform.

3. User Accounts & Obligations

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to use the Platform only for lawful purposes and in accordance with these terms. You must not misrepresent your identity, qualifications, or experience.

• Providers are responsible for verifying the suitability of agents they engage, including conducting appropriate background checks (including AccessNI checks) where required by law.
• Agents are responsible for ensuring they hold any qualifications, certifications, or insurance required for the services they offer.

4. Coins & Payments

The Platform uses a coin-based system for certain actions, such as posting job listings. Coins are purchased via Stripe and are non-refundable once used. Unused coins may be refunded within 14 days of purchase, subject to our discretion. Prices are displayed inclusive of VAT where applicable. Hirearchy reserves the right to change coin pricing at any time; existing purchased coins will not be affected by price changes.

5. Content & Listings

You retain ownership of content you submit to the Platform. By posting content, you grant Hirearchy a non-exclusive, royalty-free licence to display, distribute, and promote that content in connection with operating the Platform. You must not post content that is unlawful, discriminatory, misleading, or infringes the rights of others. Hirearchy reserves the right to remove any content at its discretion.

6. Limitation of Liability

To the fullest extent permitted by law, Hirearchy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Hirearchy does not guarantee the availability, reliability, or accuracy of the Platform. The Platform is provided "as is" without warranties of any kind, whether express or implied. Our total liability to you for any claim arising from these terms shall not exceed the amount you have paid to Hirearchy in the 12 months preceding the claim.

7. Termination

Hirearchy may suspend or terminate your account at any time for breach of these terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Any unused coins at the time of termination for cause are forfeited; if we terminate your account without cause, we will refund unused coin balances.

8. Governing Law

These terms are governed by and construed in accordance with the laws of Northern Ireland and the United Kingdom. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
